Using the Stop World War website, you can mint unique tokens (“NFTs”) on the ETHEREUM blockchain.
Acceptance
You affirm that you understand and agree to these terms and conditions, as well as any documents explicitly referenced to and incorporated by reference (“Terms”), by engaging in the pre-sale or public sale, minting NFTs, and using the Stop World War website.
Definitions
These are the Terms:
“Non-fungible token” is a term used to describe a token that is not fungible. “NFT”: A non-fungible token is a word used in the business world to represent goods such as furniture, image files, and laptops. Because of their unique features, some goods cannot be substituted by other items. NFTs are digital tokens that may be used to indicate ownership of one-of-a-kind goods. They enable us to tokenize artwork, valuables, and even real estate. They can only have one official owner at a time, and they’re protected by the Ethereum blockchain, which means no one can change the ownership record or create a new NFT.
“Fungible items,” on the other hand, may be swapped since their worth, not their distinctive features, characterizes them.
Here “you/your” means the user of the EarthSoldierNFT;
Ownership of the NFT is yours
When you purchase an NFT from the Stop World War website, you become the owner of the NFT and have the option to sell or give it away. If the NFT is linked to a perk described in the roadmap or elsewhere on the Site, you will enjoy a worldwide, perpetual, exclusive, transferable right to use that perk as long as you hold the NFT.
The Non-Fungible Token (NFT) owner created by verifying the transaction is the person who is purchasing and minting our EarthSoldier artwork. On the Ethereum blockchain, each EarthSoldier is an NFT. When you buy an NFT, you get full ownership of the underlying EarthSoldier. The NFT’s request is wholly handled by the Ethereum Network, which means we can never seize, block, or otherwise change the ownership of any EarthSoldier.
We offer you a worldwide, royalty-free license to use, copy, and display the bought EarthSoldierNFT(s), together with any extensions you choose to build or use, only for the following reasons, subject to your continued compliance with these Terms: I for your own personal, non-commercial use; (ii) as part of a marketplace that allows the buying and selling of your NFT, as long as the global market algorithmically verifies each EarthSoldier owner’s right to advertise the EarthSoldier and ensures that only the actual owner can display the EarthSoldier; or (iii) as part of a third-party application or website that allows the incorporation, interference, or participation of your EarthSoldier, as long as the website/application cryptographically verifies each EarthSoldier owner.
Notice on Data Protection and Privacy
By using the Stop World War website, you acknowledge that you have read and comprehend our Privacy Notice and that you are aware of how we collect, use, disclose and share your Data amongst ourselves, as well as how we disclose such Personal Data to our authorized service providers and third parties. We will only share your Private Information if necessary by law or to allow and administer your use of the Stop World War website. These data controllers will manage and preserve your personal information according to all relevant privacy regulations.
We retain the right to meet our internal requirements for your Data at any moment (for example, by obtaining appropriate original documents), including for fraud prevention, anti-money laundering, and counter-terrorist financing purposes.
Risks
You acknowledge and agree that accessing and using the Stop World War website entails some risks, including but not limited to:
i. Blockchain assets, including NFTs, are very volatile and vulnerable to swings in price and liquidity.
ii. Price fluctuations in other digital assets might have a considerable and negative impact on the NFTs.
iii. Legislative and regulatory changes or actions may harm NFT use, transfer, and value.
iv. NFTs are not legal tender, and no government backs them;
v. NFT transactions may be irreversible, and damages resulting from fraudulent or unintentional transactions may not be recovered.
Liability Limitability
To the maximum extent allowed by laws, Stop World War and/or EarthSoldiers shall not be liable to you or any third party for any lost profit or any indirect, incidental, special, or punitive damages arising from these terms, the site, products or third-party sites, and products, or for any damages relate the above limitations of liability do not apply to stop world war’s and/or earthsoldiers’ liability for personal injury caused by negligence or any injury caused by stop world war’s and/or earthsoldiers’ fraud or false or misleading misstatements.
Severability
Suppose any provision of this Agreement is declared invalid or unenforceable by a court or administrative body of competent jurisdiction. In that case, the invalidity or unenforceability of that provision will not affect the validity or enforcement mechanisms of the remaining provisions of these Terms, which will remain in full force and effect. Under any Applicable Laws, such provision shall be amended and construed to achieve the provision’s goals to the maximum degree practicable.
Waiver
These Terms may not be waived in whole or in part unless both parties agree in writing.
No party’s failure to enforce or delay in enforcing any of these Terms shall be interpreted as a waiver of any of that party’s other rights arising out of the breach or any succeeding breach of these Concepts, and no right, authority, or remedy conferred on or restrained for any party in these Terms is exclusive of any right, power, or remedy available to that party. Each such right, ability, or remedy shall be iterative.
Jurisdiction and Governing Law
These Terms are governed by and construed by the laws of the United States of America without respect to any choice or conflict of law principles. Any dispute, controversy, or claim, whether contractual or non-contractual, arising from or in correlation with these Terms, their breach, cancellation, or illegitimacy, or any other issue occurring in virtue of these Terms, shall be referred to and finally settled by arbitral proceedings administered under the Rules in effect at the time the Notice of Arbitration is submitted.
The United States of America will be the subject of this arbitration clause. The arbitration will take place in the United States of America. There will only be one judge. The arbitration procedures will be conducted entirely in English.
